Terms of Service

These Terms of Service ("Terms") govern your use of the Souqtopia mobile application and platform (the "App"). By using the App as a seller, merchant, buyer, or visitor, you agree to these Terms.

Part A — Sellers and Merchants

1. Registration and Verification

To register as a seller in the App, you must:

• Be of legal age in your jurisdiction.
• Provide accurate and truthful information during registration.
• Use a valid email address and phone number for communication.

The App's administration may request additional verification information from sellers, including but not limited to:

• Personal identification.
• Business activity information.
• Business address.

The platform reserves the right to reject or suspend any account that does not meet the registration requirements.

2. Product Listing

When listing products, sellers must:

• Publish accurate and clear information about the product.
• Display the actual price of the product.
• Use authentic photos or videos of the product.
• Avoid posting misleading or inaccurate information.

Any listing containing false information may be removed by the App's administration.

3. Prohibited Products

The following products may not be listed or sold:

• Drugs or controlled substances.
• Unlicensed weapons.
• Stolen goods.
• Counterfeit or fake products.
• Medications or medical materials without authorization.
• Any products that violate Iraqi law.

The App's administration reserves the right to remove any non-compliant content immediately.

4. Live Streaming

Sellers may use live streaming to showcase products and must comply with the following:

• Only present real products that are available for sale.
• Do not broadcast inappropriate content or material that violates public decency.
• Do not promote prohibited products.
• Do not provide misleading product information.

The App's administration reserves the right to stop a live stream or suspend an account in case of violation.

5. In-App Advertising

Sellers may promote their products through advertisements within the App, subject to the following conditions:

• Advertisements must be truthful and not misleading.
• Advertisements must accurately represent the product.
• Do not use false or exaggerated claims.

The platform reserves the right to remove any non-compliant advertisement or suspend the advertising account.

6. Fraud

Sellers are prohibited from engaging in any fraudulent activity, including:

• Selling products that do not exist.
• Receiving payment without delivering the product.
• Using fake product images.
• Providing false information to buyers.

If fraud is established, the platform reserves the right to:

• Suspend the account immediately.
• Permanently ban the user.
• Take legal action under Iraqi law.

7. Dealing with Buyers

Sellers must:

• Treat all users with respect.
• Respond clearly to buyer inquiries.
• Honor any agreements made with buyers.

Inappropriate conduct may lead to account suspension.

8. Returns

Sellers are responsible for defining their own return or exchange policy.

Sellers must:

• Clearly state return conditions before completing a sale.
• Honor any agreements reached with the buyer.
• Handle return requests fairly.

The platform acts as an intermediary and may help resolve disputes.

9. Ratings and Reviews

Buyers may rate sellers after completing a purchase.

Sellers must:

• Not manipulate ratings.
• Not solicit fake reviews.

Any manipulation of ratings may result in action against the account.

10. Data Protection

The platform is committed to protecting seller data and will not share it with third parties except:

• Upon official request from government authorities.
• To protect the rights of the platform or its users.
• To improve services.

11. Account Suspension or Deletion

The App's administration reserves the right to suspend or delete a seller's account in the following cases:

• Violation of platform terms.
• Selling illegal products.
• Receiving repeated complaints.
• Engaging in fraudulent activities.

12. Governing Law

These policies are governed by the laws of the Republic of Iraq. Any legal dispute shall be resolved before the competent courts within Iraq.

Part B — Visitors and Buyers

1. Platform Usage

Users may browse products and interact with sellers within the App, provided they:

• Comply with applicable laws.
• Use the App in a legal and ethical manner.

2. Purchasing

When purchasing a product through the App, the buyer must:

• Carefully read the product details.
• Verify the price and specifications.
• Contact the seller in case of any inquiry.

The App functions as an intermediary platform and is not directly responsible for the sale transaction.

3. Live Streaming

Users may watch live streams and interact with sellers.

Users must comply with the following:

• Do not post abusive comments.
• Do not harass sellers or other users.
• Do not post content that violates the law.

The platform reserves the right to ban any user who violates this policy.

4. Fraud

Users are prohibited from:

• Attempting to deceive sellers.
• Using false information.
• Engaging in any fraudulent activity.

Such conduct may lead to account suspension and legal action.

5. Advertisements

Users may see advertisements within the App.

Users must:

• Not misuse advertisements.
• Not copy advertisement content for unlawful purposes.

The platform is not responsible for agreements concluded outside the App.

6. Returns

Before purchasing any product, the buyer should:

• Review the seller's return terms.
• Confirm the product specifications.

In case of an issue, the buyer may:

• Contact the seller directly.
• File a complaint with the App's administration.

7. Reviews

Users may rate sellers after completing a purchase.

Reviews must be:

• Truthful.
• Based on a genuine experience.

Any fake reviews may be removed.

8. Privacy

The platform respects users' privacy and is committed to protecting personal data such as:

• Name.
• Phone number.
• Email address.

9. Platform Misuse

Users are prohibited from:

• Posting abusive comments.
• Harassing other users.
• Attempting to compromise the App.

Such conduct may lead to account suspension.

10. Policy Updates

The App's administration reserves the right to amend these policies at any time. Users will be notified of updates within the App.

11. Governing Law

These policies are governed by the laws of the Republic of Iraq. Any legal dispute shall be resolved before the competent courts within Iraq.
